Chapter 7: available to most individuals, married couples, corporations, and partnerships. In most cases, the Debtor (you) will receive a discharge on any personal liabilities for “dischargeable” debts. Some debts are not dischargeable — taxes, and student loans, to name two.
Chapter 11: “Reorganization” bankruptcy restructures a business (i.e., corporation, sole proprietorship, partnership, etc.) and requires a Debtor-in-Possession account to be used by the entity while in the process. Typically not what you would want to use if you run a small business.
Chapter 13: a “reorganization” plan for the average person — individuals, families, small business owners — Chapter 13 enables you, if you have a regular income, to repay all or part of your debt in installments, from 36 to 60 months. It can allow you to hold onto important assets like an automobile or home.
